1. Acceptance of Terms
By accessing or using the GVOICE platform operated by Your Digital Sathi ("Company"), you agree to be bound by these Terms of Service. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Service Description
GVOICE provides an AI-powered voice calling platform that enables businesses to automate outbound and inbound phone calls using artificial intelligence. Services include AI voice agents, call campaign management, lead management, call analytics, and related tools.
3. Account Responsibilities
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
4. Acceptable Use
You agree to use our platform only for lawful purposes and in compliance with all applicable Indian laws, including but not limited to:
- TRAI Telecom Commercial Communications Customer Preference Regulations
- Do Not Disturb (DND) / NCPR registry requirements
- Calling window restrictions (10:00 AM to 7:00 PM IST)
- AI disclosure requirements in the first 30 seconds of each call
- Information Technology Act, 2000 and its amendments
- Digital Personal Data Protection Act, 2023
You must not use the platform for spam, fraud, harassment, or any activity that violates TRAI regulations.
5. Lead Data & Consent
You represent and warrant that you have obtained proper consent from individuals before uploading their contact information to our platform and initiating calls. You are solely responsible for ensuring compliance with DND/NCPR requirements for your lead lists.
6. Billing & Payment
- Usage is billed per minute based on your selected plan
- All prices are in Indian Rupees (INR) and exclusive of applicable GST
- Prepaid minutes expire at the end of the billing cycle
- Refunds are not provided for unused minutes unless required by law
7. Service Availability
We strive to maintain 99.9% platform uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for service interruptions caused by third-party providers, network issues, or force majeure events.
8. Intellectual Property
The GVOICE platform, including its design, code, AI models, and documentation, is the intellectual property of Your Digital Sathi. Your call data and lead information remain your property. We claim no ownership over your content.
9. Limitation of Liability
To the maximum extent permitted by Indian law, our total liability for any claims arising from use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
10. Termination
Either party may terminate the agreement with 30 days written notice. We may suspend or terminate your account immediately if you violate these terms or engage in activities that risk TRAI penalties. Upon termination, your data will be retained for 30 days and then permanently deleted.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
